Contractual Issues

CLC Contractual Best Practice Guidance

The Construction Leadership Council (CLC) has issued best practice guidance for contracts during COVID-19. The guidance provide examples of the types of issues that are likely to arise, together with practical advice on how to resolve them in a constructive manner. They are supported by government.

A New Normal in Contractual Practice 

Build UK has published guidance on A New Normal in Contractual Practice which details why certain terms should be avoided and sets out how to manage issues more effectively and ensure a fairer allocation of risk. The guidance was updated on 5 February to include JCT contracts.

Wedlake Bell Contractual Guidance

There is now specific guidance available for CONSTRUCT members to access on the contractual issues that are arising because of COVID-19. This guidance has been commissioned by Build UK and produced by Wedlake Bell, and covers force majeure and frustration, variations, pandemic clauses and more. Remember that CONSTRUCT members can also contact CONSTRUCT for details of how to access the Wedlake Bell helpline for specific contractual issue advice as part of your CONSTRUCT membership.
